Yes. The Department of Justice has consistently deemed that the ADA’s requirements apply to accessibility of website pages. Adherence to WCAG guidelines not only improves search engine optimization (SEO), but it also helps to ensure your website is accessible to all customers. Plus, adhering to these guidelines lowers the chances you’ll face legal issues due to ADA non-compliance.
Automated accessibility testing alone will not make your website accessible. Plugins and overlays claim to fix the site and content for you, but more than 70% of accessibility issues cannot be detected or fixed without human input. In fact, overlays often make accessibility worse and offer a false sense of security. A document or website could pass a checker and not be accessible.
Always combine automated testing with manual auditing. The reason for this is that some WCAG criteria are ambiguous. For example, automated accessibility tests can tell you if an image has alternative text, but they can’t understand the context.
No automated evaluation, line of code or AI tool can tell you if your site is accessible or compliant.
You most likely do, even if you don’t know it. You can’t see all disabilities and you can’t see all your users. Potentially 20% or more of website visitors or readers of digital documents have a disability. Many disabilities cannot be seen, such as color blindness, epilepsy, hearing loss or ADHD. And when they come to your website, you can’t even see the visible ones, such as a lost limb or blindness.
The Web Content Accessibility Guidelines (WCAG) provides a framework for making digital content accessible. The guidelines are considered the standard for accessibility with governments and courts using them as a reference in settling accessibility lawsuits.
WCAG guidelines focus on four principles: Perceivable, Operable, Understandable, and Robust (POUR).
The vast majority of websites do not meet these guidelines and as a result are legally vulnerable.
While we will make a reasonable effort to bring your website into conformance according to WCAG Version 2.1 Level AA standards, we cannot guarantee 100% ADA compliance. Although there are widely accepted guidelines for web accessibility, the lack of any official standards makes the legal landscape a bit of a gray area. The nature of web development and evolving standards means that achieving full compliance can be complex. What we can do is help improve your accessibility and remediate the biggest accessibility issues listed in most ADA lawsuits.
As we strive to provide an affordable accessibility option for our clients, we don’t have real users (users with disabilities) test the website for any issues or improvements.
